Terms & Conditions for “Off-the-Shelf” / “Ready-to-Purchase” Plans
1. Scope of Work
· WSHP offers a wide range of “off-the-shelf” / “ready-to-purchase” detailed house plans prepared by and/or under the supervision of a person registered with the South African Council for the Architectural Profession (SACAP).
· These ready-to-purchase plans are not customised to fit a specific stand. This is an additional service that can be arranged. (For more information, please contact our office.)
· The plans focus on the relationship between different rooms and spaces, the use of materials and services, and the functional and technical characteristics of a building. They provide a framework to assist in the planning process.
· The purchase includes floor plans, elevations, a section, and a window and door schedule, all provided in a single PDF file.
· An editable DWG file is available for purchase as an add-on.
· A Bill of Quantities is available for purchase as an add-on (if available for the selected plan).
2. Scope of Services
· When purchasing a ready-to-use plan from WSHP, no professional service agreement is established.
· The only service included is the delivery of the purchased PDF (and any selected add-ons) to the email address provided by the customer.
· Any additional services beyond this scope will require a separate agreement and may incur additional charges. Please contact the office for more information.
3. Legislation
· In terms of the National Building Regulations and Building Standards Act No. 103 of 1977, Section 4(1):
“No person shall, without the prior approval in writing of the local authority in question, erect any building in respect of which plans and specifications are to be drawn and submitted in terms of this Act.”
4. Limitations of Responsibility
· WSHP takes no responsibility for any unauthorised building.
· WSHP takes no responsibility for adapting plans to meet site-specific rights, restrictions, or constraints.
· WSHP takes no responsibility for the approval of plans by the relevant authorities.
5. Responsibility of the Customer
· It is the customer’s responsibility to ensure that accurate information (including a valid email address and South African telephone number) is provided.
· It is the customer’s responsibility to obtain approval for all plans before commencing any building project.
· Important: Submission to Council and any related administration or liaison is explicitly excluded from WSHP’s service. The customer is fully responsible for this process.
· Important: When checking out and making payment, please ensure that you have made the correct selection. Once payment has been received and the files have been sent, the payment is non-refundable.
6. Copyright & Intellectual Property Rights
· Retained Copyright: The design remains the intellectual property of the architect, and WSHP reserves the right to resell or reuse it.
· In accordance with Board Notice 7 of 2021: Code of Conduct for Registered Persons, consent must be obtained from WSHP for the use of this architectural work.
· Upon purchase, a one-time consent is granted to the registered professional responsible for submitting the project for approval with the relevant authorities.
· The purchase of a plan does not grant permission for repeated or multiple uses.
· Plans may not be resold under any circumstances.
7. Confidentiality
· All client information and project details will be treated as confidential and will not be shared with third parties without explicit consent.
· WSHP employs appropriate security measures to protect customer information.
· All client information will be managed in accordance with the Protection of Personal Information Act (POPIA).
8. Governing Law
· These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.
· Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts located in Gauteng, South Africa.
9. Acceptance of Terms
· By proceeding with a purchase, the customer acknowledges and agrees to these Terms & Conditions in full.
10. Refunds and Cancellations
· All sales are final. Due to the digital nature of our products, refunds, returns, or exchanges will not be granted once the files have been sent.
· If an incorrect file has been delivered due to an error on our side, WSHP will provide the correct file at no additional cost.
11. Limitation of Liability
· WSHP shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of the purchased plans.
· The customer assumes full responsibility for ensuring that the designs comply with local building codes, site conditions, and municipal requirements.
12. Professional Responsibility
· Only a registered person with SACAP may take professional responsibility for adapting and submitting the plans to the relevant authority.
· WSHP expressly disclaims responsibility where plans are used without the oversight of a registered professional.
13. Amendments to Terms
· WSHP reserves the right to amend or update these Terms and Conditions at any time.
· The most recent version, as published on our website, will apply to all transactions.
